General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all orders placed through the KreativPünktchen online shop operated by Seidel Präzisions- und Frästeile OHG, Leerser Str. 3, 08209 Auerbach/Vogtland, Germany (“we”). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code).

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. By submitting your order via the order button you make a binding offer to conclude a purchase contract. The contract is concluded when we accept your order by sending an order confirmation by e-mail.

3. Personalised products

For personalised products we manufacture exactly according to your specifications (for example wording, names, dates, an uploaded logo or photo). Please check your entries carefully before submitting your order, especially the spelling. You warrant that the content you submit (text, logos, photos) is free of third-party rights, in particular that it does not infringe any copyright, trade mark or personality rights, and you indemnify us against any corresponding third-party claims. We are entitled to refuse orders with unlawful content.

4. Prices and shipping costs

All prices stated are in euros and include statutory VAT, plus shipping costs. The shipping costs are shown to you during the order process before you place your order.

5. Payment

Payment is made using the payment methods offered during the order process.

6. Delivery

Delivery is made to the delivery address you provide. Personalised items are made individually for you once your order has been received. Information on processing and delivery times can be found on the relevant product page and during the order process.

7. Retention of title

The goods remain our property until payment has been made in full.

8. Right of withdrawal

Consumers generally have a statutory right of withdrawal. Please see our instructions on withdrawal for details. There is no right of withdrawal for goods made to customer specification or clearly tailored to personal requirements (Section 312g(2) no. 1 of the German Civil Code); this applies in particular to our personalised stamps and engravings.

9. Warranty

The statutory rights in respect of defects apply. Our products are made from natural materials such as wood; slight variations in grain and colour that are typical of the material do not constitute a defect.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In the case of simple negligence we are liable only for the breach of material contractual obligations (obligations whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely), limited to the foreseeable damage typical of the contract.

11. Contract language and contract text

The contract languages are German, English and Dutch. The language in which you completed your order is the one that applies. The order data will be sent to you by e-mail with the order confirmation; you can view these terms on this page at any time.

12. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

13. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence.
